These Terms cover your use of zecondshift.com and our services. By using the site or buying a service, you agree to them. If you buy on behalf of a company, you confirm you can bind that company. Paid work is also governed by your order form or client agreement; if the two conflict, the order form wins.
1. Who we are
Zecond Shift is a GrowthHit company operated by Hit Lab Ventures LLC, 1700 Westlake Ave N, Suite #200, PMB #0745, Seattle, WA 98109 ("Zecond Shift", "we", "us"). Contact: info@growthhit.com.
2. Who can use our services
Our services are for businesses. You must be at least 18 and buying for business purposes, not personal or household use.
3. What we provide
We set up an AI Office for your business: The Brain (your business knowledge, organized for AI), The Office (AI workflows for the rooms in your order) and The Shift Report (a daily summary sent to your chosen channel). Your order form lists exactly what is included, the tools we connect to and the timeline. Features named on our website describe what is available; your order form controls what you receive.
4. Plans, fees and cancellation
- The 30-Day Build: a one-time fee of $3,795, paid in full before kickoff.
- Build & Maintain: $3,795 for the build plus $695 a month, billed in advance each month from go-live. It includes updates for new AI models, features and connectors, fixes and upkeep, and up to 2 hours of changes and support a month. Unused hours do not roll over.
- No long-term commitment: you can cancel the monthly plan at any time by email. Ordinary cancellation takes effect at the end of the current billing month, and you keep the Office built for you. A refund under the 30-day money-back guarantee ends your service and use of the delivered Office, as described below.
- Refunds before kickoff and outside the guarantee: Build fees are refundable if you cancel before kickoff. Once work starts, build fees are non-refundable except under the 30-day money-back guarantee below, where required by law or agreed by us in writing. Outside the guarantee, you can cancel maintenance before the next billing date to avoid the next charge; a maintenance period already started is non-refundable except where required by law. If we cancel before delivering the agreed work, we refund fees for the undelivered portion.
- Taxes: prices exclude sales and similar taxes, which we add where required.
- Late payment: we may pause work or monthly service if an invoice is more than 15 days overdue, after giving you notice.
- Price changes: we will give at least 30 days' notice before changing the monthly price.
30-day money-back guarantee
Your AI Office is backed by a full-refund guarantee for 30 days after go-live. The window starts when the agreed Office is live and available for your use, not when you pay or when the build begins. We confirm the go-live date in writing.
If it is not the right fit, email info@growthhit.com within 30 days of go-live to request a refund. We refund 100% of the setup fee and any maintenance fees paid during that guarantee period. This guarantee applies to both The 30-Day Build and Build & Maintain.
A full refund ends the engagement, ongoing service and your right to retain or use the delivered AI Office, including its configured Brain, workflows and prompts. You agree to stop using it and cooperate with its removal or deactivation in your tools, including removing retained copies of the Office setup. Your own accounts, business data and materials you supplied remain yours and are not surrendered under this policy.
Cancelling maintenance without a refund is different: you keep your paid-for Office. The guarantee does not promise a particular business result and does not limit any rights you have under applicable law.
5. Your responsibilities
- Give us accurate information, timely answers and the access we need to your tools.
- Keep your existing software accounts and subscriptions active. We build your AI Office on the tools you already use; no new platform subscription is required for the agreed setup.
- Review and approve content before it is published or sent. You are responsible for what you publish, including product claims, ad platform policies, email and text-message consent rules, and industry rules that apply to your business.
- Keep your account logins secure and tell us if access should change.
6. AI output
Our work uses AI. AI output can be wrong, incomplete or similar to content made for others. Review it before you rely on it or publish it. Output is not legal, tax, financial or medical advice.
7. No guaranteed results
We deliver working automation, not business outcomes. We do not promise any level of sales, leads, rankings, traffic, conversion rates or return on ad spend. Case studies and testimonials on our site describe what specific GrowthHit clients experienced; they are not typical and your results will vary.
8. Who owns what
- You own your data, accounts and materials you provide. You own the deliverables we create for you (your Brain, workflows, prompts, reports and content) once paid for, and keep them if you cancel maintenance without a refund. If you receive a full refund under the 30-day money-back guarantee, your right to retain and use the delivered AI Office ends. Your own accounts, business data and materials remain yours.
- We own our pre-existing methods, templates, frameworks and know-how. We grant you a permanent, non-exclusive license to use any of them that are built into your deliverables, for your own business. This license ends for the refunded Office if you receive a full refund under the 30-day money-back guarantee.
- Third-party tools remain owned by their providers and are used under their terms.
9. Confidentiality and data
Each of us will keep the other's non-public business information confidential and use it only to perform or receive the services. We handle personal information in your data as your service provider under our data processing addendum, and our Privacy Policy covers information about you as our contact.
10. Third-party services
Your AI Office depends on tools we do not control, such as AI platforms, email platforms, ad platforms and analytics. If a provider changes its features, pricing or access, we will adapt your setup within your plan where we reasonably can, but we are not responsible for the provider's outages or changes.
11. Using our website
Do not misuse the site: no scraping at scale, interfering with security, uploading malware or using our content to build a competing product. Site content, logos and design belong to us or our licensors. Brand names and logos of tools we work with belong to their owners and do not mean those companies endorse us.
12. Disclaimers
Except as stated in your order form, the site and services are provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
13. Limits on liability
To the extent the law allows, neither of us is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim arose. These limits do not apply to fraud, willful misconduct, or your payment obligations.
14. Indemnity
You will defend us against third-party claims arising from content you approve and publish, your data, or your breach of these Terms, and pay resulting costs and damages. We will do the same for claims that our own materials, as delivered, infringe someone's intellectual property.
15. Disputes
If a problem comes up, email us first and we will both try in good faith to resolve it within 30 days. These Terms are governed by the laws of Washington, and disputes go to the state or federal courts in King County, Washington.
16. Changes and ending these Terms
We may update these Terms and will post the new version here with a new date; we will email clients about material changes at least 30 days ahead. We may suspend service for non-payment or serious misuse after notice. Sections 7, 8, 9, 12, 13, 14 and 15 survive after the Terms end.
